  • This document is known as the “Patio Heater Promotion” (Promotion) Terms and Conditions.
  • Information regarding prizes and how to enter forms part of these Terms and Conditions. By entering, Entrants accept these Terms and Conditions.
  • Entry for the Promotion is only open to:
    • Licensed plumbers registered in Australia aged 18 years or over; and
    • Licensed apprentice plumbers registered in Australia aged 18 years or older
  • A consumer who meets the criteria for entry is known as an Entrant
  • Only one entry is allowed per Entrant and per Australian plumbing licence number.
  • Only individuals may enter the Promotion.
  • Directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of Bromic (Promoter) or any of Bromic’s subsidiary companies are ineligible to enter the Promotion.
  • The Promotion begins at 9am (AEST) on 26/06/09 and closes at 11.59pm (AEST) on 30/09/09 (Promotional Period).
  • Entries for the Promotion are deemed to be received at the time of receipt into the Promoter's database, not time of transmission.
  • Promotion
    • There is no game of chance involved with the Promotion.
    • To participate in the Promotion, Entrants must complete the registration process during the Promotional Period by doing the following:
      • Visit http://www.bromic.com.au, click on the relevant link and follow the prompts to register
      • Entrants must answer the Promotion Question (which appears on the form) within the word or character limit specified by the Promoter.
      • Answers to the Promotion Question will be judged individually by the Promoter based on a set criteria of honesty and constructive feedback given.
      • Entrants who are deemed to provide 1(one) of the best 10(ten) answers to the Promotion Question will be a Winner.
      • There will only be 10(ten) Winners in the Promotion, but the Promoter may increase this number at its sole discretion at any time without prior notice
    • Each winner will receive a Patio Heater (Prize) valued at $549 recommended retail price (RRP) including GST.
    • The Prize is a Stainless Steel Deluxe 50 Di Patio Heater (Product Code: COMP710-2).
    • Winners could wait up to 30 days after the Promotion closure date to receive their prize.
    • Winners will be notified within two (2) weeks of the Promotion closure date by email or phone and may be asked to verify their details before the Prize can be officially claimed. Identification considered suitable for verification is at the Promoter's discretion.
    • In the event of a Prize not being accepted or claimed within 3 months of the closure date, the relevant winner's entry will be deemed invalid and the Promoter reserves the right to award another Entrant as a Winner using the same criteria specified above.
    • From time to time, the Promoter may run special promotions. These promotions may be communicated via mail, email, SMS or within participating retail stores.
    • The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings and independent financial advice should be sought.
  • General
    • If the Promoter deems an entry is false, misleading or has not complied with the conditions of entry, the Promoter will discard that entry and award another Entrant as a Winner using the same criteria specified above. The judges’ decision is final and no correspondence will be entered into.
    • The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this Promotion by, any person who tampers with, or benefits from any tampering with the entry process or with the operation of the Promotion or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
    • The Prizes are not transferable or exchangeable. If the Prize specified above is unavailable for any reason, the Promoter may substitute another item of equal or higher value as determined by the Promoter.
    • Winners must, at the Promoter's request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material.
    • If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion, or invalidate any affected entries where required.
    • The Promoter accepts no responsibility for any late, lost, incomplete, misdirected, incorrectly submitted, delayed or illegible entries, claims or correspondence whether due to error, omission, alteration, tampering, theft, deletion, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over the Internet, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise.
    • The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this Promotion or accepting or using any Prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
    • Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage in transit to Prizes.
    • Any tax, liability or duty arising from an individuals’ participation in the Promotion, is the sole responsibility of the Entrant.
    • All entries will be the property of the Promoter. The Promoter may disclose Entrants' personal information to its contractors and agents to assist in conducting this Promotion or communicating with Entrants. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter. The Promoter reserves the right to alter or amend these Terms and Conditions, and conditions of operation of the Promotion, without prior notice and at the Promoters absolute discretion.
    • All entries may be entered into a database and the Promoter may use Entrants' names and addresses for future promotional, marketing and publicity purposes, if consented to by Entrants on the registration form.
    • A notice shall be deemed to be given by the Promoter to the participant if it is sent to the postal or email address of the member appearing in Promotional database.
  • Termination
    • The Promoter reserves the right to suspend or terminate the Promotion at any time without prior notice.
    • The Promoter will not be liable for the suspension or termination of the Promotion on any account whatsoever.
  • Privacy
